Legal Separation
John Anderson Law can discuss with you the advantages or disadvantages of filing for a legal separation versus filing for a dissolution of marriage. John Anderson Law is committed to providing its clients with the facts they need to make these important decisions that impact their lives.

Interrogatory
An interrogatory is a process by which formal written questions are answered under oath in a written form.

Depositions
A deposition is an oral examination which poses questions regarding your case to the opposing party. Answers are to be given under oath and under penalty of perjury. For example in a divorce a deposition might ask questions about money and custody arrangements.

Money Support Wage Assignment Orders (Garnishment)
If the California family law court determines that child support is owed, the employer is given complete rights to withhold monies from an employee’s take-home pay. The court determines the amount that will be withheld, or garnished, for how long and in what manner. Once the court order is issued and the employer is notified, the wage assignment begins.

Fair Child Custody Agreements
The welfare and safety of a child or children is always the primary concern of the attorneys at John Anderson Law. We will help you protect your family and create a reasonable agreement that best serves your child’s needs.

Determining Appropriate Child & Spousal Support
In a California divorce it is vital that the amount of child support is fair and reasonable. The attorneys at John Anderson Law will explain how child support and spousal support are determined by the court using the Dissomaster program and will help you request the proper amount. It is important to know that joint custody and visitation can affect the amount of child support. We will ensure that your rights are protected in the determination of child and/or spousal support agreements.

Enforcement: Overdue or Unpaid Spousal and Child Support
We will help you calculate how much and when you may begin collecting spousal support (alimony) and what to do in the event that your spouse does not pay in a timely matter. We will also help you determine arrearages in child support or family support and secure a court order enforcing the payment of those arrearages.

Ownership of the Family Residence
As a community property state, legal ownership of the family residence in California may be a major point of settlement in a divorce. Unless a residence is determined to be separate property and if no prior agreement exists, ownership of the family residence will be determined in the final divorce decree.

Attorney Fee Awards
In a case of California family law, the costs of attorney’s fees are determined in the court’s final decision. It is important that your attorney ascertains who will pay the legal fees of all parties involved in your case and that the determination is included as part of the court’s final decree.

Modification of Divorce Decree / Judgment of Dissolution
The terms of a California divorce decree may be modified if your personal finances or other circumstances have changed. The California family legal team at John Anderson Law will help you attain the adjustments you seek through the proper legal channels.

Adoption / Stepparent Adoption
In California, adoptions can be done by licensed private or public agencies. Children may also be adopted through the California Department of Social Services (CDSS). Petitions for stepparent adoptions may be filed in the Superior Courts. A transfer of parental rights from birth parents to adoptive parents requires a court order and should be facilitated by an attorney. Guardianship of Minors
